When someone passes away there are a number of important tasks that need to be completed. If the person that passed away left a valid Will, then the named ‘Executor’ in the Will will take the responsibility of administering the estate.  In the absence of a valid Will, the person is said to have died “Intestate” and in this case a close relative can apply to court and grant permission to deal with the estate. Probate or Intestacy is the name given to the administering of the estate of someone who has recently passed away without leaving a valid Will.

Legal heirs may decide to employ a solicitor to act as the Executor or Administrator of the estate of their beloved ones to make their life easier in these difficult times.  Otherwise, heirs may decide to act personally as Executor or Administrator and instruct a Solicitor of their choice to assist them with the Estate Administration. Legal fees are normally settled by the deceased’s Estate.
